Booking and Participation Terms for Pol Voyage Expeditions
1. Parties, Roles and Definitions
1.1. Pol Voyage acts as an agent/retailer selling package travel organised by Agence Attinia Travel (Tunisia).
1.2. The organiser of the packages (within the meaning of package travel regulations) is solely Agence Attinia Travel – it is responsible for the proper performance of all services included in the package and holds insolvency protection.
1.3. Organiser compliance evidence: before accepting any booking, Pol Voyage requires written statements and documents from the organiser (policy/guarantee/other security, insurer/guarantor details, period of validity, territorial scope, repatriation conditions) confirming compliance with service performance and financial security requirements. Upon the Client’s request, Pol Voyage will provide information on who provides such protection and to what extent. (This clause protects Pol Voyage from the “automatic” assumption of organiser obligations when selling packages organised outside the EEA). EUR-Lex
1.4. Pol Voyage does not combine services in its own name and does not sell flights – travellers purchase airline tickets independently (no ATOL on the side of Pol Voyage; if a flight is purchased by a client in the UK, ATOL protection applies only where the seller holds ATOL/acts as an ATOL agent). 1.5. Information on the programme, services, standard, minimum number of participants, meeting times and service language is provided in the description of the relevant package on www.polvoyage.com and in the booking confirmation.
2. Booking and Formation of the Contract
2.1. Bookings are made via the form on www.polvoyage.com.
2.2. The package contract is concluded between the Client and the organiser and is formed after: (i) submission of the booking request, (ii) payment of the deposit, (iii) confirmation of acceptance of the booking by Pol Voyage (as agent) and by the organiser.
2.3. The person making the booking declares that they act on their own behalf and on behalf of the named participants and are responsible for the accuracy of their data.
3. Price, Scope of Services and Payments
3.1. Total package price: £1,300 per person, including the services specified in the package description (7 nights in twin rooms, board as per programme, 4×4 transport, entrance/park fees, support of a Polish tour leader and local team, water in vehicles).
3.2. The price does not include: flights, insurance, optional services (e.g. quad bikes, hammam, dromedaries), drinks, tips, souvenirs and personal expenses.
3.3. Deposit: £400, payable within 24 hours of the booking request to the Pol Voyage account; the deposit is non-refundable and deductible from the total price. Failure to pay on time = cancellation.
3.4. Balance: £900, payable in cash on site on the day the package starts, directly to the organiser’s representative (against their receipt).
3.5. The date of payment is the date the funds are credited. Any bank transfer fees are borne by the Client.
3.6. Any price changes are possible only in the cases and manner provided by the organiser (e.g. taxes, fees, exchange rates – no later than 20 days before the start of the package; if costs decrease after the contract is concluded, a corresponding price reduction applies). 4. Client Changes and Cancellations
4.1. Cancellation is possible at any time – the deposit is non-refundable.
4.2. Transfer of the booking to another person or date is possible subject to the organiser’s availability; the Client covers actual change costs (e.g. accommodation, transport, administrative).
4.3. If unavoidable and extraordinary circumstances occur at the destination (e.g. a serious security risk), the Client may terminate the package contract without a termination fee – in accordance with the organiser’s terms. EUR-Lex
5. Changes/Cancellation by the Organiser
5.1. In the event of a significant change to the main characteristics of the services, the organiser will offer alternative arrangements at no additional cost (equivalent or higher; for lower – a price reduction).
5.2. If the organiser cancels the package, the Client receives a 100% refund of payments made to the organiser/through the organiser.
5.3. Responsibility for the performance of services and substitute services lies exclusively with the organiser (Pol Voyage relays communications and provides organisational support to the Client as agent). European Union
6. Performance of Services, Complaints and On-site Assistance
6.1. Complaints concerning performance of services must be reported without delay on site to the organiser’s tour leader/representative and to Pol Voyage (to enable a swift response). Pol Voyage, as agent, will promptly forward the complaint to the organiser and assist with communication. ABTA
6.2. 24/7 emergency contact: the booking confirmation will include a duty phone/WhatsApp number and email.
6.3. Pol Voyage is liable to the Client solely for due intermediation. The organiser is liable for any lack of conformity of the services with the contract.
6.4. If the Client incurs justified and necessary costs to remedy a significant lack of conformity after an unsuccessful request for intervention – they are entitled to reimbursement in accordance with the organiser’s rules. ukinbound.org
7. Insurance
7.1. The Client must hold medical and accident insurance (recommended: baggage, third-party liability and cover for activities they intend to undertake – e.g. quad biking, riding dromedaries).
7.2. Lack of insurance excludes the liability of the organiser/Pol Voyage with respect to insurance benefits (medical treatment, hospitalisation, medical transport, loss of baggage).
8. Travel Documents and Health Requirements
8.1. The Client is responsible for holding a valid passport and meeting entry requirements (visa – if required), as well as sanitary and customs regulations of the destination/transit country.
8.2. Pol Voyage provides information and support but is not liable for decisions of authorities (e.g. refusal of entry/visa). Lack of required documents is not grounds for a refund.
8.3. For example: for tourism to Tunisia, nationals of many countries may enter visa-free (up to 90 days) – however, a passport valid for at least 6 months is required; recommendations may change, so the Client must check current requirements. Travel
9. Nature of Desert Expeditions – Safety
9.1. Programmes include off-road travel in desert terrain; appropriate clothing, hydration, following the instructions of tour leaders/drivers and use of seat belts are required.
9.2. Participation in optional activities (e.g. quad bikes, dromedaries) may require additional health declarations and insurance cover in accordance with the insurer’s terms.
9.3. The organiser may refuse to admit to a given activity a person whose health/safety raises justified concerns (without a refund where the refusal results from the Client’s fault/circumstances).
10. Personal Data Protection (GDPR)
10.1. The controller of booking data is Pol Voyage; data are processed for the purpose of handling bookings and performing services (Art. 6(1)(b) GDPR) and for possible claims handling (Art. 6(1)(f) GDPR).
10.2. Data recipients: the organiser (Tunisia) and its subcontractors – to the necessary extent. Transfers outside the EEA are based on necessity for performance of the contract with the Client and/or consent, with information about potential risks.
10.3. Client rights: access, rectification, erasure, restriction, objection; complaint to the competent authority (PUODO/ICO) depending on Pol Voyage’s place of business and the Client’s residence.
10.4. Retention period: for the duration of contract performance and the limitation period for claims.
11. Governing Law and Disputes
11.1. The intermediation contract with Pol Voyage is governed by the law of the country of Pol Voyage’s seat; the package contract with the organiser is governed by the law of the organiser’s seat, provided that the Client does not lose protection afforded by mandatory provisions of the country of their habitual residence if Pol Voyage/the organiser direct their activities there.
11.2. Disputes with Pol Voyage are resolved by the court having jurisdiction over Pol Voyage’s seat, unless mandatory provisions provide otherwise.
11.3. Pol Voyage provides a complaints procedure; information about alternative dispute resolution (ADR/ODR) is published on the website.
12. Image and Promotional Materials
12.1. The participant consents, free of charge, to the recording and use of their image (photographs, video recordings) taken during the package by Pol Voyage or persons acting on its behalf, for Pol Voyage’s marketing and promotional purposes (in particular publication on the website, social media, advertising materials).
12.2. The consent covers dissemination of the image without territorial or time limits.
12.3. The participant may object at any time to the use of their image by sending a notice to info.polvoyage@gmail.com; in such case, Pol Voyage will cease further publication of materials featuring their image.
13. Miscellaneous
13.1. Information on the website is for information purposes; the binding terms are those in the booking confirmation and the organiser’s documents.
13.2. Pol Voyage is not liable for: (i) airline changes/delays, (ii) loss/damage of baggage in air transport, (iii) force majeure (weather, decisions of authorities, strikes).
13.3. Amendments to these Terms are announced on www.polvoyage.com and apply from the date of publication.
